1. Introduction / Acceptance of Terms
These Terms constitute a binding agreement between you (“you”, “User”) and Goglo ("we", "us", "our"). By accessing or using Goglo (the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization, and “you” refers to that organization.
2. Definitions
- Service: The websites, applications, APIs, and related offerings provided by Goglo.
- Account: A registered profile enabling access to certain features of the Service.
- Content: Any text, images, video, audio, prompts, uploads, and other material submitted or generated through the Service.
- AI Output: Content generated by or through AI models made available via the Service.
- Credits: Units used to access metered features or model invocations.
- Subscription: A recurring paid plan that may include Credits and/or feature entitlements.
- User: Any person or entity accessing or using the Service.
3. Eligibility / User Obligations
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the consent of a parent or legal guardian. You agree to provide accurate information, comply with applicable laws, and not misuse the Service.
- No attempts to breach security, probe, or disrupt the Service.
- No circumvention of usage limits, rate limits, or quotas.
- No use for illegal, harmful, misleading, or infringing activities.
4. Account Registration & Security
You may create an Account using email/password or supported OAuth providers. You are responsible for maintaining the confidentiality of your credentials and for all activities under your Account. We may suspend or terminate Accounts that violate these Terms.
5. Use of the Service / License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service. Unless otherwise specified, you may use AI Output for personal or commercial purposes, subject to applicable model provider terms, third-party rights, and laws.
You are responsible for reviewing any applicable model terms and ensuring that your use of AI Output complies with them. We do not guarantee the originality or exclusivity of AI Output and make no warranties regarding third-party claims.
Unless otherwise stated, we do not use your private inputs or outputs to train our proprietary models. We may process Content for abuse detection, debugging, analytics, and to improve the Service as permitted by law and our Privacy Policy.
6. Credits, Billing & Payments
- Credits are consumed when invoking metered features or models. Credit costs may vary by feature/model and are subject to change.
- Expiration: Unless otherwise stated, Credits are non-refundable and expire 12 months after purchase.
- Subscriptions renew automatically until canceled. You may cancel at any time to stop future charges; benefits continue until the end of the current period.
- Payments are processed by third-party providers (e.g., Stripe). Taxes and exchange rates may apply.
- Refunds are assessed case-by-case where required by law; otherwise, all fees are non-refundable.
7. Prohibited Uses
- Generating illegal, violent, sexual, hateful, harassing, or deceptive Content.
- Infringing intellectual property, privacy, or publicity rights.
- Reverse engineering, scraping, automated harvesting, or abusing APIs.
- Interfering with system integrity, security, or availability.
8. Intellectual Property
The Service, including software, interfaces, designs, trademarks, and model integrations, is owned by Goglo or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted, no license is granted to you under any IP rights.
To the extent you submit Content, you represent you have all necessary rights. You grant us a limited, worldwide, non-exclusive, royalty-free license to use, host, reproduce, and display such Content solely to operate and provide the Service.
9. Termination / Suspension
We may suspend or terminate your access to the Service at any time if you breach these Terms or if required by law. You may stop using the Service and request account deletion via support. We may retain certain information as permitted by law and our Privacy Policy.
10. Disclaimers / Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI OUTPUT WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Goglo BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THAT PERIOD.
11. Governing Law / Jurisdiction
These Terms are governed by the laws of California, USA, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California, for any dispute not subject to arbitration.
12. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
